He excels in strategic consultation for IP rights, Information Technology, Regulatory Law, Advertising, and Marketing. A member of key Mexican and international organizations: ECTA, ASIPI, INTA, IACC, GALA, ANADE, AMEDEP, and the Federal Circuit Bar Association, he has held high-level positions within such associations and bears various legal domains, showcasing expertise and international connections. Accomplished legal professional with extensive experience in privacy compliance, regulatory advisory, and data governance. She joined Arochi & Lindner in April 2025 as Of Counsel to lead the Privacy Practice for the Firm. As former Regional Chief Privacy Officer at Citigroup, she spearheaded privacy initiatives across Mexico, LATAM, and the rest of the Americas, developing robust privacy compliance frameworks and advising senior leadership on risk mitigation. Prior to joining Citi, she led the Privacy Practice at a local Law Firm in Mexico, providing strategic counsel to clients across various industries on data protection, commercial agreements, and crisis management. Her legal foundation was established through a decade of leadership roles in the Mexican Federal Government, where she focused on transparency, privacy rights, and anti-corruption. She holds a Law Degree from ITAM, post-graduate diplomas in banking and financial law, and anti-corruption, complemented by CIPM and CIPP/US certifications from IAPP. Montserrat graduated from Universidad Panamericana and has more than six years of experience in Intellectual Property matters. During her professional career, Montserrat has focused her legal practice in the strategic advice of a variety of matters, among them, the protection, enforcement, defense and exercise of Intellectual Property rights. Intellectual Property Litigation is one of her main areas of expertise; in which she has excelled for managing several litigation matters brought before administrative and jurisdictional authorities, as well as arbitration proceedings before the World Intellectual Property Organization for disputes related to domain names (UDRP and LDRP). Her broad knowledge and experience in Consumer Protection matters (including e-commerce), together with her continuous training in the area of Privacy and Personal Data Protection, her keen vision and analysis, allows her to guarantee our clients insightful, comprehensive advice and intervention regarding these matters, distinguishing her as a talented lawyer and Privacy Professional.

- The New Era of Privacy and Data Protection in Mexico: What’s Changing?The Mexican legal system has undergone an unprecedented transformation in the past few months. This has impacted several areas, including but not limited to the dissolution of INAI, former regulator for transparency, access to public information, privacy and personal data protection.30 September 2025
- Transparency, personal data and the proposed reform in Mexico.Mexico's approach to personal data protection operates through distinct frameworks for the public and private sectors. The Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP ), established in 2010, governs private entities without reform to date. The public sector is regulated by the General Law on Protection of Personal Data Held by Obligated Subjects (LGPDPPSO1), in effect since 2017. The National Institute of Transparency, Access to Information, and Personal Data Protection (INAI1) ensures compliance in the private sector, while state-level bodies, constitutionally autonomous, guarantee enforcement in the public sector. However, ongoing discussions emphasize the need to reform and possibly unify these frameworks to create a more streamlined and coherent regulatory environment for personal data protection. The potential dissolution of the INAI, as proposed in a constitutional reform, raises concerns. Such a move could disrupt efforts to modernize and harmonize data protection laws, creating uncertainty about the future of transparency and data protection in Mexico.29 August 2024
